Are you guys working with or with the permission of Hasbro, because if you're not, wouldn't that mean a high probability of C&D?

I'm fairly certain so, but as I'm not a member of the team, I can't clarify that. Even if not, there's far more pony games using far more copyright material.

Now, No they are not working with Hasbro, but they don't use much copyrighted material. They avoid using characters (which as far as I have seen, seems to be the primary reason for C&Ds.

The funny thing about it, is that Hasbro is aware of this project and has yet to close this project down. <3
We have tried to contact Hasbro a handful of times, but with no response every time
If we do receive a C&D we can take the website down, make the changes necessary, and be able to keep working on the game

You have to realize they arent going to C&D every game they hear about, filing a C&D take a good bit of money and a few months, they arent going to do it unless they feel it is worth it
This has been asked many times. It is highly unlikely for LOE to receive a C&D with a good reason because LOE will not be using any canon characters.

We aren't using
any copyrighted material at all. Copyrights are for intellectual property such as characters, toy sets, etc, as you pointed out. What we
are using are Trademarks (words/brand names). Both Trademarks and Copyrights are context-locked, meaning that the word/IP is not owned universally, but rather only in a specific context such as on TV or in a toy set. "Ponyville" and "Cutie Mark" are the only trademarks we're using, but technically/legally not in the same context. Hasbro can still attempt a C&D, but with very weak legal grounds. Even then, all we have to do is change the names.

Alternate names for Ponyville, Canterlot, Appleloosa, Cloudsdale, the Everfree Forest, and the Crystal Empire? Hmm.. Chrystal Kingdom, Neverfree Forest (appropriate amiright?), Pegasopolis, Appleville, Canterbury, and Ponyton maybe?

I'm no legal guru, but I figured that a trademark isn't protected from similar sounding things or that'd just multiply how insane the laws are already.. This is why a lawyer brony would be useful for LoE

This is how copyright law is messed up. Supposedly they
must defend their IP or they lose their right to it, but if they were to properly "defend" it then no fan artist would sell a print or custom of their work (or make smiley icons of Hasbro characters). I assume the law only expects Hasbro to defend their IP within reason. They need not pursue every forum or fan artist that infringes on their IP.
